I just read through your post, by USSailing rules the final tie breaker is who beat who last, and if there is a throw then it's never looked at in the tie breaker.

Alex's bad race was because he got caught napping on the beach. For me, I'd rather loose in a tough tie break rather than win because someone got caught napping. It's all good, and it was a great regatta regardless of the weather.
