Do sailboats ALWAYS have the right of way over power boats? or do standard "rules of the road" (not racing rules) override the sail power versus motor power in some occasions? Example: if this collision occured between two power boats, the boat to the port side of the other is responsible for giving way, right??

Eastern NC, USA | I agree and always try to stay clear of any traffic while cruising. I may push it a little further if racing, but usually opt to tack/gybe away before quarters get tight (especially when dealing with boats plowing through the middle of a race course - "ohh, look at that pretty buoy - wonder what that means???").
So... in open water, the TheMightyHobie18 in this story should have given way to the power boat? Assuming sailing upwind, trapped out on the port side... Sorry to be such a moron, but I;d rather not replicate the "pucker factor".

It's not like Danny wasn't looking downwind under the boom at ALL! The Bayliner was traveling at close to 40mph when it hit us. Eastern NC, USA | I was not trying to assess blame. I sail in a tea pot most of the time; however, I do venture to the open water a couple of times a year and would like to understand as best I can. Obviously, a boat going twice+ your speed is going to surprise anyone (closing speeds become a big factor). I did not mean to condemn your and Danny's efforts to sail safely.
You guys probably felt like the Snipes and Lasers that I share a race course with. They used to try their monohull tactics on me, but now they just let me go -as I'll be gone shortly.

A couple of things to add to the discussion (not necessarily to this particular accident): Any boat overtaking another has to keep clear. Sail or power. The fishing boat thing listed above is a narrow definition the mostly covers commercial type operations. Bobby Joe trawling for rockfish doesn't count, although he might disagree. As the privileged vessel in crossing situations, you have a responsibility to make it easier for the other boat to maneuver away. And this generally means you need to hold course for as long as possible. Of course, this needs to be balanced against picking a bail-out point to avoid collision if it comes to that. | | | Re: right of way from the US Coast Guard
