Unregistered | Who has right of way in this situation: (Not racing)
Boat M (Mystere 5.5) was Leeward boat, on a starboard tack, in the intra-coastal channel (actually perhaps just a little Leeward of the channel)
Boat N (Nacra 5.0) was windward, zips (cuts) in front of me, basically cutting me off and yells starboard... forcing me to put my boat in irons, and literally pop the jib, lift rudders and centerboards to back up (I couldn't jibe due to the shallows on the left) to avoid hitting him (he then hit the channel marker)

The Nacra to windward was reaching or running? And overtaking you at the same time?

I think the following boats have more "rights": - Starboard tack - leeward boat (if on same tack) - boat being overtaken (regardless of tack or if under power)
Am I missing something?

Did he sail around you, dip in front and under you, and then round you up?
You said you couldn't jibe...did you mean tack? If you were close hauled and run upward, you would be faced with a tack and not a jibe.
I think I need a drawwring.

As a matter of good seamanship, I would think an overtaking boat should allow the boat being overtaken room to maintain course & speed or give room to maneuver...

At a crossing, you lose and must back off EARLY. Tacking to avoid you would have (and did) put me into the channel marker. The problem is that you are a Fockholepunkter! I think Andrew might have been sailing close-hauled or close to it, and the other boat dove down on top of him, maybe on a broad reach?
Maybe Andrew threw the boat in irons to "duck" the overtaking boat at the last minute, or somehow stop his boat altogether to avoid collision?

The wind was out of the NNE and you were sailing east up the channel on port. I had just tacked at the south side of the narrow channel and was pinching north across the channel on starboard. Sir, i agree with everything you say except i also don't agree that i am a "Fockholepunkter" Perhaps my recollection was wrong... but i thought we were both on a starboard tack (as we were all leaving the beach, headed south to the bridge)... As i was about to tack away from the marker and you came in front of me and yelled "Fockholepunkter". Are you saying you were south of me and coming up to the same point as me, and some how turned in front of me and then hit the marker??? I need a diagram... do you have a witness? Is there a police report?

Funny, those aren't the terms you used to describe the boat when you sold it to me.
